Living question · provisional

Can the Amazon soy moratorium regain signatories despite tax restrictions?

Tax policy can undo a forest commitment’s incentive while leaving its text legally intact.

What we currently think

The pact's legality is protected, but the fiscal disadvantage remains. Renewed participation has not been established.

Soy can keep its rule and lose its signatories

In Brazil, an agreement can leave court both protected and weakened. On August 12, the Supreme Federal Court upheld the Amazon soy moratorium but retained Mato Grosso and Rondonia laws restricting participants’ tax benefits. The Court nevertheless requires the applicable constitutional delays, the next tax year and/or ninety days depending on the case, and preserves existing exemptions granted subject to conditions already undertaken by the taxpayer. Those are real protections without removal of the fiscal disadvantage.
